Agents: Quirky Properties Limited: 3 Innerwood Road, Kilwinning, Ayrshire KA13 7DU
Owners: The legal Owner/s or other persons for the time being entitled to the Property or its rental income
Customer: The person reserving or booking the Property for the Period.
Property: The Property specified on the Booking Form.
Period: The period of time specified on the Booking Form for which the Customer is to occupy the Property for holiday purposes.

1. THE CONTRACT
The Quirky Properties Limited (“the Agent”) acts on behalf of the property owner. The Contract entered into is between the owner of the holiday accommodation and the holiday maker (“the hirer”). The contract is only effective once the completed booking form and required payment have been received and written confirmation has been sent to the hirer. The booking is made with the Owner through us and is made in Scotland. The Contract is subject to Scottish Law.

2. PAYMENT
For reservations made more than eight weeks before the holiday start date, a deposit of one third of the rental cost is payable. For bookings made less than eight weeks before arrival, full payment is required on booking.

3. BALANCE OUTSTANDING
The deposit is non-refundable. The total holiday cost is payable to Quirky Properties Limited not later than eight weeks before the holiday start date. Failure to make full payment at the appropriate time may result in the cancellation of the booking and the forfeiture of the deposit.

4. CANCELLATION
The Hirer is strongly advised to arrange holiday cancellation insurance to give protection in the event that the hirer is unable, for any reason, to take up the holiday accommodation at the agreed time. The Hirer should notify Quirky Properties Limited of any cancellation immediately in writing. For any cancellation before the arrival date or on arrival, not only will any deposit be forfeited but also the balance of the total holiday will also be payable by the hirer. If the property can be re-let then an appropriate refund will be made.

5. BOOKING ALTERATION
Rarely, for reasons beyond the control of Quirky Properties Limited, we have to cancel or alter arrangements made for the hirer. In this event Quirky Properties Limited guarantees to return to the hirer any payment made. If for reasons beyond the control of the Owner or Agent the property is not available for the period the Agents will endeavour to offer alternative accommodation of a similar type and standard at the same cost as that originally booked by the customer. If the alternative accommodation is not acceptable to the Customer, or no alternative accommodation can be offered, the Agent will refund in full all monies paid and be under no other liability. The hirer is responsible to check that the booking details are correct, the booking agent must be informed of inaccuracies or requirement changes immediately (within 24hrs) as any changes made thereafter will incur an admin fee of £20 per change made..

6. DESCRIPTIONS
Quirky Properties Limited carefully inspects all properties and makes every effort to describe them fairly. However, we cannot be responsible for changes beyond our control, which have not been notified to us.

7. OCCUPANCY
Occupancy shall be from 4pm on the day of arrival to 10am on the day departure unless otherwise agreed by Quirky Properties or the owner. It is NOT permitted to exceed the maximum number of persons staying at the cottage.

8. CARE OF THE PROPERTY
The hirer is responsible for leaving the accommodation in good order and in clean condition. The hirer is responsible for ensuring that he and all members of his party behave in a responsible manner both in relation to the property and the general neighbourhood and village during the holiday period. A refundable deposit of £150 (UK Pounds) is paid to Quirky Properties Limited on booking your holiday accommodation. This will be returned to you after the holiday after deducting the cost of any breakages to the property, loss or damage to linen supplied or the provision of any extra services required to return the property to its original condition (please allow up to 28 days for return of the payment). Any excess will be paid to the hirer who should report any breakages/damages to Quirky Properties Limited. In the case of any breach of this condition, which is considered serious by Quirky Properties Limited or the Owner, the right to repossess the property during the holiday period is reserved.   Smoking is strictly prohibited within the cottage.

9. NUMBERS OF PEOPLE USING THE HOLIDAY ACCOMMODATION
Under no circumstances may more than the maximum number of persons as stated in the brochure occupy a property. Admittance may be refused if this condition is not observed. Quirky Properties Limited and the owner reserve the right to refuse or revoke bookings from parties which may in their opinion, be unsuitable for the property concerned. In such cases, all hire charges will be refundable in full and the contract will be discharged.

10. LIABILITIES
Neither Quirky Properties Limited as Agents nor the Owner of your holiday accommodation can accept liability nor loss of any nature whatsoever suffered by any person from any cause whatsoever arising in connection with that person’s occupation or attendance at the holiday accommodation.

11. COMPLAINTS PROCEDURE
The hirer must notify Quirky Properties Limited immediately if a problem arises and we will do our best to rectify it as soon as possible so that we can ensure that you enjoy the rest of your holiday with the minimum of inconvenience. We cannot recompense you if we are not made aware of any problem at the time and you must write to us confirming the complaint within seven days of the end of your holiday.

12. PETS
Pets are NOT allowed in the advertised property.

13. AMENITIES
The use of amenities where offered, such as swimming pools, golf, fishing, holistic therapies etc are at the Users risk and the Agents/Owners will not accept responsibility for loss or damage to the Customers belongings, personal injury or loss of life. Availability of amenities cannot be guaranteed.

14. HOLIDAY AND PERSONAL INSURANCE
We strongly advise you to take out holiday Insurance to cover any eventualities that may result in you having to cancel your holiday. We strongly suggest that your own personal holiday insurance is taken out to cover any losses, accidents, damage, injury, expense or inconvenience whether to person or property, which may arise out of or in connection with the period booked.

15. RETURN OF PERSONAL BELONGINGS
In the event of any personal items being left in the property, Quirky Properties Limited will collect, pack and send the items back to you for a minimum charge of £12.00 ( cost depending on size and weight of items )

16. JURISDICTION
The Terms and Conditions shall be read and construed in accordance with Scottish Law and the parties herby submit to such jurisdiction.

17. DISCLAMER
Neither Quirky Properties Limited as Agents nor the Owner of your holiday accommodation can accept liability nor loss of any nature whatsoever suffered by any person, their property or vehicle from any cause whatsoever arising in connection with that person’s occupation or attendance at the holiday accommodation or surrounding area whilst occupying the property.
